Judge Rules Hernandez's Lawyers Have Cause to Interview Witness
Tuesday, July 28
Brian Steele of MassLive.com reported Judge Susan Garsh ruled Hernandez's lawyers have "good cause" to interview a witness who claimed a juror was exposed to materials not submitted in the case which may have influenced the verdict.
On July 4, the Associated Press, per Fox News detailed the claims:
"Massachusetts judge has authorized a subpoena so lawyers for former New England Patriots player Aaron Hernandez can identify an anonymous tipster who claimed one of the jurors who convicted Hernandez of murder may have been "untruthful" during jury selection.
Judge Susan Garsh ruled Friday that Verizon can be subpoenaed to determine the identity of the tipster who called attorney James Sultan in April, after Hernandez was convicted in the 2013 killing of Odin Lloyd.
The judge said the caller's credibility can be determined only by first learning her identity.
Sultan says the tipster called him from a blocked number and said the juror was present for a discussion about a Boston double murder Hernandez is also accused of committing.
"
On June 5, Michele Steele of ESPN reported (full document here) the reasoning and details behind Hernandez's alleged shooting of witness Alexander Bradley. Per Bradley, Hernandez shot him because he brought up the incident in Boston. He also claimed to have been shot in the head and chest.
Hernandez pled not guilty to a charge of attempting to "silence a witness in a double murder case by shooting the man in the face," according to the Associated Press on May 21.
On May 11, Michele McPhee of Boston ABC News reported that Boston prosecutors had charged Hernandez with shooting Bradley, who was a witness to the 2012 double homicide. Michele Steele noted that the indictment claims Hernandez shot Bradley after the latter made a remark about the homicide.
Michael McCann of Sports Illustrated reported that the charge carries a 10-year sentence.
Michele Steele reported that Hernandez's status hearing for the double homicide will be on May 21.
Hernandez stands accused of gunning down De Abreu and Furtado in Boston at the Cure Lounge as the two sat in De Abreu's BMW on July 16, 2012. There was a third man in the car who was wounded but not fatally shot.
According to a statement released by the Suffolk County District Attorney in April (via Brandon Schlager of Sporting News), Hernandez is also being charged with "three counts of armed assault with intent to murder and one count of assault and battery by means of a dangerous weapon for shots fired at three surviving victims; and one count of unlawful possession of a firearm."
A long investigation into the double homicide finally resulted in an indictment for Hernandez in May of last year.
