
Tennessee WR Josh Smith's Alleged Assault Victim Wants Charge Dropped
Kennedy Foster, who was allegedly the victim of domestic abuse by Tennessee Volunteers wide receiver Josh Smith, asked prosecutors to drop the charge against Smith on Tuesday, according to Don Jacobs of the Knoxville News Sentinel.
Per Jacobs, "Knox County General Sessions Court Judge Tony Stansberry on July 7 is expected to officially dismiss the charge against Smith."
Smith agreed to a deal and will perform 40 hours of community service and pay $334.25 in court costs, per the Associated Press (via the New York Daily News).
According to WATE.com, Smith allegedly assaulted Foster in early May after the roommates got into a fight. Per that report:
"Police said the fight started after Foster locked himself in his bedroom. Smith told police he became concerned for Foster’s well-being and broke down the door. When he entered the room, Smith told police Foster 'looked at him as if he was an intruder,' then a fight broke out. 'We fought, and he got the better side,' said Foster."
Jimmy Hyams of WNML reported that Smith and Foster have been "long-time friends" and share a house together off-campus.
According to Jacobs, Smith's lawyer Keith Stewart will request that the court expunge the charge against the wide receiver.
