According to the New York Post's Rebecca Rosenberg and Daniel Prendergast, 19-year-old Justin Brown alleged that the Cavaliers shooting guard choked him after he made a joke about the January 2015 trade that sent him from the New York Knicks to the Eastern Conference champions.

In January, Rosenberg reported that charges against Smith had been dropped.

"After a thorough investigation of the circumstances surrounding this case, we have concluded that the evidence does not support criminal charges against Mr. Smith," Manhattan district attorney spokesman Patrick Muncie said in a statement, per Rosenberg.

Citing a source, Rosenberg reported that a cellphone video captured prior to the altercation features Brown saying, "I am going to get J.R. to punch me and sue him for $50,000."

On June 9, the New York Daily NewsShayna Jacobs reported Brown's lawyers filed documents in court "asking for a default judgment in their $2.5 million lawsuit in Manhattan Supreme Court on the grounds that Smith’s lawyers never filed a response to their civil claim."

According to Jacobs, Smith's lawyer, Alex Spiro, said the 2-guard has yet to receive any sort of formal paperwork regarding the lawsuit.
