Ontario County District Attorney Michael Tantillo has convened a grand jury to determine whether charges should be brought against NASCAR driver Tony Stewart for his role in an on-track incident that caused the death of driver Kevin Ward Jr.

Grand jury testimony began Tuesday in the case.

Chuck Hebing, who was driving in the Aug. 9 race when Ward was killed at Canandaigua Motorsports Park, confirmed that he was called to testify about the accident but declined to discuss the matter further.

Following an investigation into the tragic death of Kevin Ward Jr. after he was struck by a car driven by NASCAR's Tony Stewart at a dirt track race in New York, the case will be sent to a grand jury.

Ontario County District Attorney Michael Tantillo, in an official statement via Jeff Gluck of USA Today, said this is the right decision based on the information gathered:

Over the past several weeks, I have reviewed with members of the Ontario County Sheriff's Department their investigation, as it progressed, in the Tony Stewart matter. Recently that office concluded its work and forwarded the complete case file to me. Upon my review of all of the information contained in the entire investigation, I have made the determination that it would be appropriate to submit the evidence to a grand jury, for their determination as to what action should be taken in this matter.

Accordingly, the evidence developed in the investigation will be presented to an Ontario County grand jury in the near future.

"

Gluck's report also notes that Tantillo couldn't specify an exact date when it would be scheduled. All he could reveal was that it would be in the "near future." 

Stewart released his own statement following Tantillo's, via Jenna Fryer of The Associated Press, saying that he will give his complete cooperation to this process:

NASCAR announced (via SB Nation's Jordan Bianchi) that Stewart can continue racing during the case, and Nate Ryan of USA Today reported that the Stewart-Haas Racing team has confirmed Stewart will take part in Sunday's Sylvania 300 event at New Hampshire Motor Speedway:

NASCAR also released a statement, via Fryer, saying that it was going to "monitor" the situation and not provide a comment on anything regarding the investigation:   

Ward died on Aug. 9 when he got out of his car following an accident on the race track. He appeared to be motioning in the direction of Stewart's car when the incident occurred. Stewart did not race for the next three weeks as the investigation was ongoing.    

Stewart would return to the track on Aug. 31 at the Oral-B 500. The investigation by the Ontario County Office of Sheriff was completed on Sept. 11 and sent to the district attorney's office for review with Tantillo issuing his decision on Tuesday.
