Dwyane Wade's Foundation Sued for Band Drumstick Mishap
There's news of the weird, and then there's the wonderland of surrealism Dwyane Wade calls life.
According to TMZ, Wade's World Foundation is being sued after someone attending a charity event in Chicago last year was struck accidentally by a marching band's drummer. Plaintiff Andrea Alexander is reportedly seeking a minimum of $50,000—which is to say we've officially seen it all.
Never has an aisle seat been so hazardous.
Per TMZ, Anderson is maintaining that "one of the band's bass drummers whacked her in the head with his bass drum mallet ... causing her 'severe and permanent injuries.'"
The legal issue at stake is whether or not there was any negligence on the part of Wade's foundation. In order to establish that, Alexander will first have to show she was actually harmed. The claim of "severe and permanent" injury might be tenuous, but then again, marching bands aren't there to drum softly.
Some of us might have seen it coming—like everyone else who had an aisle seat and somehow managed to avert catastrophe.
Apparently, Ms. Alexander didn't see Drumline.
To win this one, she'll also need to demonstrate that a reasonable person could have foreseen a risk of injury. If Wade's foundation instead proves only the most paranoid prognosticator could have seen this one coming, that $50k won't be going anywhere.
Or anyway, it won't be going to Alexander. There are any number of deserving places it could go, though. According to its website, Wade's foundation aims "to provide support to various educational, health and family service programs, in particular those that benefit underserved communities."
The foundation has been pursuing those objectives since its inception in 2003, holding a variety of events like the W3 Weekend in Chicago and All-Star luncheon, both of which occur annually.
