Andy Pettitte's Testimony Produces Reasonable Doubt and a Win for Roger Clemens

According to the New York Times, Andy Pettitte, exhibiting his class, character and honesty, testified that he was only 50 percent certain that Roger Clemens had told him he had ever used human growth hormone.

Defense lawyer Michael Attanasio made a statement that is the winning "hit" against the government's ridiculous case against Clemens.

“As you sit here today, you believe in your heart of hearts and your mind that you very well might have misunderstood Mr. Clemens in 2002 and 2004,” Attanasio said to Pettitte. “Sitting here now, you’re 50-50 that you misunderstood him, is that fair?”

Pettitte simply replied, “I’d say that’s fair.”

Pettitte's testimony creates reasonable doubt, which means that "...no other logical explanation can be derived from the facts except that the defendant committed the crime, thereby overcoming the presumption that a person is innocent until proven guilty."

A logical explanation has been derived from Pettitte's testimony. He has testified that there is as much of a chance he misunderstood Clemens as there is that he didn't misunderstand Clemens. The most reliable defense witness has told the truth and the truth must free Clemens.

The previous day, Pettitte had testified that in 1999, Clemens' first season with the New York Yankees, or possibly in 2000, his good friend told him that he had used human growth hormone. Attanasio's questioning Pettitte the next day revealed that Pettitte was only 50 percent certain of what Clemens had told him.

During spring training in 2005, Pettitte asked Clemens what he would do if he were asked if he had ever used HGH.

Under oath, Pettitte stated that Clemens' response was “What are you talking about?” and added that Clemens said he had told him that it was his wife that had used the hormone.

The show must go on, Brian McNamee will testify, the prosecutors will look ridiculous, money will be wasted and Clemens will be exonerated.
