Floyd Mayweather: Will Lawsuit Distraction Cause Floyd's Defeat Against Ortiz?
The legal team of unbeaten boxer Floyd Mayweather Jr has reportedly filed an emergency motion in a Nevada court seeking the postponement of his deposition on the defamation case filed by Manny Pacquiao, citing his upcoming fight with Victor Ortiz on September 17 as the reason for filing the emergency motion.
Pacquiao sued Mayweather Jr, his father and some members of his team for statements made alleging Pacquiao was taking performance enhancing drugs without presenting any evidence to support their claims.
The Judge handling the case denied the motion filed by Mayweather's lawyer.
"Federal magistrate Judge Robert Johnston denied an emergency motion Thursday that would have allowed Mayweather to delay testifying. Mayweather claimed that he needed to concentrate on his upcoming fight against Victor Ortiz, which is scheduled for Sept. 17," ESPN.com reports.
With the court ruling denying the motion, Pacquiao's lawyer Dan Petrocelli, plans to seek judgement by default, according to L.A.Times.
"We're anxious to get to trial and, as a result of this, we'll be seeking a default judgment to win the case by default in the upcoming weeks," Pacquiao attorney Daniel Petrocelli said. "This is just ducking a deposition,"
According to the report, Petrocelli said Mayweather's lawyer sent him a letter Thursday saying the unbeaten boxer could not attend the scheduled deposition because "he planned to appeal the order for him to be there."
Meanwhile Arum said Pacquiao is determined to push the case and added that "it will necessitate more than just a public apology for Pacquiao to withdraw the case against Mayweather, his father Floyd Sr. and the boxer’s uncle Roger."
“It’ll require more than that,” said Arum.
In the motion for the postponement of the deposition, Mayweather's lawyer has cited the boxer's need to concentrate on his upcoming fight.
From the statement, it appears Mayweather considers the lawsuit as a distraction in his next fight with Ortiz.
Now that his motion has been denied by the court, boxing insiders say if Mayweather gets distracted during his training, it could cause his defeat against Ortiz.
