Derrick Rose Loses Summary Judgment Regarding Sexual Assault Civil Suit

The sexual assault case against New York Knicks guard Derrick Rose will go to trial after his request to throw out the lawsuit was denied, per Dan Werly.

Per the official U.S. District Court of California record (via Werly), Rose's motion to throw out the case was denied because there is "a genuine dispute of material fact as to the central issue in this action: whether plaintiff consented to sexual intercourse with defendants in early morning of August 27, 2013."

Werly added that Rose did win a motion "to break up the punitive damages aspect of trial and to exclude/limit plaintiff's expert witnesses."

In August 2015, TMZ reported that Rose was being sued by a woman who said she dated him from 2011 to 2013 and was "drugged and gang raped" by the former NBA MVP and two of his friends, identified as Ryan Allen and Randall Hampton

The woman, per TMZ's report, said she was able to escape Rose's house after "they slipped a drug into her drink with the aim of raping her," but Rose and his friends broke into her apartment later and "gang raped her while she was incapacitated."

A spokesperson for Rose denied the allegations made against the former NBA All-Star, per Liz Mullen of SportsBusiness Journal. Rose said he was "not going to comment other than to say I know the truth and am confident I will be proven innocent," per K.C. Johnson of the Chicago Tribune

In September, per TMZ, Rose filed court documents claiming the accuser "consented to sexual interaction with more than one co-defendant on more than one occasion, consented to sexual interactions on the day in question and invited the defendants to her apartment and buzzed them in."

Per TMZ, court documents filed by Rose's accuser showed she is seeking $21.5 million in damages, and the site noted the trial is likely to start in 2017.
