Santa Clara police lieutenant Kurt Clarke told NBC Bay Area following McDonald's arrest in May that the 30-year-old "physically assaulted the victim while she was holding a baby."
McDonald's civil attorney, Steve DeFilippis, responded to NBC Bay Area with an email stating, "according to at least one witness, there was no physical contact between the two. Thus, it is hard to understand why charges are being pursued."
The Chicago Bears, who signed McDonald as a free agent in March, immediately released him following the arrest.
This arrest marked the second time in less than one year McDonald had been arrested. The first occurred in August 2014 on suspicion of domestic violence, but charges were not filed in that case.
In December 2014, McDonald was released by the San Francisco 49ers after being named as a suspect in a sexual assault investigation. He has since filed a lawsuit against the woman accusing him of rape.
