Miller's sister was able to get out of the headlock and call the police to have her brother arrested. Miller was charged with simple assault and false imprisonment last week following the incident.

Miller has since been able to post bail and was subsequently released.

Miller was arrested before back in December of 2005 for assault and burglary in Hawaii. Miller was accused of kicking in the door of his girlfriend's apartment and assaulting a man inside.

The first-degree burglary charge could have landed Miller in jail for 10 years. Miller was acquitted of those charges.
