Boogity Man Darrell Waltrip Threaten a Lawsuit Against a Canadian
The Boogity Boogity man Darrell Waltrip has threaten a lawsuit against a Canadian shop owner for using his Boogity Boogity as the name of his small NASCAR memorabilia shop.
According to an article in INSIDER RACING NEWS.COM (by the way a most for race fans daily read).
The small shop owner was infringing on his trademark Boogity…Boogity.
If that is a registered trademark , he has every right to do file the complain.
But there is a bigger question here.
What was that shop owner thinking?
I personally can think of 100 store front names more appropriate than Boogity, agree?
Who in the world is going to know what that word means, I’m a big NASCAR fan and to this day I have no idea what Boogety, Buogaty means, do you?
Please explain it to me if you do, Please!
If I see that name in a store front, I would think is a Halloween costume shop where I can buy scary stuff, “buuugitty ghosts buuggity” boo…boo.
The small shop owner made a wise decision, he is taking the name down.
Here is a quote from Mr. Randy Nicholson I found in a Canadian blog:
“Nicholson argues that he has never infringed on Waltrip's rights. He
says he has never sold anything that carried Waltrip's trademark, and
the few Boogity-related items he sold bore a logo that he developed on
his own.
"I really don't understand this,'' Nicholson said. "It is not like I
was making money off of Darrell Waltrip's name. It's a word for
goodness sakes- 'boogity' - and I am not even sure it is a real word.
It's a redneck word.
"If I had a million bucks I'd be nose to nose with him." End of quote.
You got to love Mr. Nichols, just a “Redneck Word” will become a classic quote.
Make sure you Trademark that Mr. Nichols.
By the the way the store also sells hockey, wrestling and ultimate fighting souvenirs.
You know folks I can understand Mr. DW protecting his property but this is silly , he could of just call the guy and talk to him and worked something out.
Well, maybe he did and Mr. Nichols told him to bugggiidy out of there.
Either way it looks like pie in the face for Mr.DW.
A big rich power man against a corner store little shop owner probably with a family who depends on him.
Just another David and Goliath story.
