Details of Allegations Revealed in Affidavit

Tracey Kaplan of the Mercury News reported on the details of an affidavit surrounding the allegations against Ray McDonald:
The woman who claims former San Francisco 49er Ray McDonald sexually assaulted her told police the alleged attack occurred after she fell or passed out by the pool at his house on Dec. 13 and hit her head on the ground, according to a search warrant affidavit released by the courts Monday.
She woke up the next morning naked in bed with McDonald at his Silver Creek home, according to the affidavit. Initially, McDonald told her he let her sleep in his bed because she was tired.
But later that Sunday morning, she said the former defensive lineman told her they had sex. Yet she spent the rest of the day and into the evening drinking with him and 49er linebacker Aldon Smith, who had dropped by. Smith is on probation for drunken driving and possession of three assault rifles.

McDonald Under Investigation for Alleged Sexual Assault

San Francisco 49ers defensive lineman Ray McDonald is being investigated for an alleged sexual assault.
According to Matt Barrows of The Sacramento Bee, the San Jose Police Department said "it is investigating a sexual assault allegation," but no one has been arrested at this point:

According to police, at approximately 10:43 a.m. on Tuesday police received a call from a local hospital regarding a possible sexual assault victim who was receiving treatment. Officers responded and made contact with the adult female victim. The victim alleged she was possibly sexually assaulted a day prior. The preliminary investigation revealed the alleged suspect was Ray McDonald.
Barrows also wrote that "police obtained a search warrant based on a preliminary investigation and served it at McDonald's San Jose home Tuesday."
The alleged victim reportedly was not McDonald's fiancee, according to Damian Trujillo of NBC Bay Area:

This news comes one month after McDonald had domestic violence charges stemming from an alleged incident in August dropped by the Santa Clara District Attorney's Office, via Tim Keown of ESPN.com.
McDonald, 30, has played in 14 games for the 49ers this season, recording 39 tackles and three sacks. The eight-year veteran has spent his entire career in San Francisco after being drafted out of the University of Florida in 2007.
