I pray De Sean Jackson uses his head while he can, and gets out of the game. I played for the 49ers in 80 & 81 (Super Bowl), and developed hydrocephalus from repeated concussions dating back to my 3rd year of Pop Warner at age 13 when I was hospitalized after knocking myself unconscious in a tackling drill.
Emergency VP Shunt brain surgery during the 81 Super Bowl season a few weeks after a knee surgery, two more brain surgeries ten hours apart, just four months after we won Super Bowl XVI and not only was I given last rites, but the hospital bills by the 49ers.
Currently on brain surgery # 9 and counting.

While the NFL and NFLPA are both posturing as they are, regarding who's doing what, for whom, there is a lot more at stake than Millionaires fighting Billionaires. The big question for many of us is; "What in the hell are they going to do about discarded, used ex players such as myself?"
Twenty nine years since "retiring" from the NFL at age 23 after my first NFL Caused Emergency VP Shunt Brain Surgery and knee surgery, I have now survived 9 emergency VP Shunt brain surgeries, and two more knee surgeries including a GoreTex ACL transplant.
Brain surgeries # 2 & # 3 occurred May, 82, just 4 months after we won Super Bowl XVI, and not only was I given last rites, I was also given the hospital bills by the 49ers. For nearly 5 years I had creditors on me (while undergoing 2 more knee surgeries to repair what the 49ers butcher never fixed right, and multiple gran mal seizures), and was forced to sue for WORKERS COMP!!!
Finally won my case in 1986 to get past and future medical paid for. I thank God I won, as I am now on emergency brain surgery # 9, and STILL DON"T QUALIFY FOR NFL BENEFITS.
Dodged a bullet just last Saturday. Woke up with headaches, which is my life, which got progressively worse during the day. The bulb on the pump on my shunt, which is placed under the skin at the back of my head, was hard and not pumping. This usually means the shunt is not working, (not draining spinal fluid from my brain to my abdomen), which means I will be in a coma shortly and die if not operated on. Paul, I played for SF 49ers in 80 & 81 (Super Bowl) and underwent emergency VP Shunt brain surgery early in the 81 season. Brain surgeries # 2 & # 3 followed 4 months after we won Super Bowl XVI and I was not only given last rites, but the hospital bills.. 5 yrs had creditors on me till I successfully sued the 49ers for WORKERS COMP!!!
Now on brain surgery # 8 and still fighting. Below is an email I sent in order to be evaluated by Dr Amen after being referred there by my primary care.

First of all I thank you for doing all you have over the years to try to interface between me, the 49ers, and the screwed up policies The Travelers seem to have. I apologize for dragging you through this, but I am at the end of my rope dealing with incompetent people on my case. You surely remember how my case was sent to you in the first place (I had to physically threaten the previous claims adjuster to get several months of back disability checks out of him), and it seems as though we are back to square one. I have had major headaches the last two days and not sure if brought on by the stress or if a precursor to my shunt going out.
I had stressed to you when Dr Claydon recommended I attended the Dr Amen clinic for a full evaluation (months ago???), that I wanted it from Oct 17 – Oct 24 (while my wife Kristi is on Fall break from her full time teaching position), as it is imperative she be able to fill in the blanks for me during my evaluation. I literally can not remember what I did this morning. You mentioned it was $3,750 and you were not sure they would approve it. I then requested from you how much The Travelers has spent on me since my original injury with the 49ers in 1981. You sent a disability breakdown of $78,000 I have received over 28 yrs. (A little over $2,700/year!!!). Now I have learned to live extremely scrupulous, living in rentals in the ghetto till I was married at age 37, living on $3.75/day for food while on disability, and working 2 – 3 jobs, after my 12 surgeries and multiple hospitalizations due to seizures, and purchasing my very first home (a fixer upper I worked on for 5 yrs) at the age of 39, but $3.75/day to eat on is a bit skinny even for one such as myself who prides himself in procuring much of my own food with my bow and arrow or fishing pole.
I also asked how much my hospitalizations have cost, and requested a face to face with the powers to be at the Travelers (DO Gutierrez???), so I can explain my situation in that I just want my life back, I want a relationship with my wife and kids again where they are not constantly afraid I will go OFF on them, and I hope to God that I never even speak to the freaking Travelers again for the rest of my life.
Instead, I wait (through 2 medicine changes mind you), to be EVALUATED BY SOME DUMB ASS WHO DOESN”T EVEN KNOW WHEN, WHERE, HOW, OR WHAT I am taking, seeing or doing. I receive the approval YESTERDAY dated 8/27 – 9/26 (what happened with Kristi attending to tell the Drs what I am like? I will pay her expenses. Why is there such a short window when the Travelers has drug their feet for so long? )
Unfortunately none of this has happened so now I am pissed. Right or wrong when I am pissed I go into the warrior mode that has made me successful in everything I have ever attempted. From football, to finishing my education, to opening successful businesses with major memory problems, you name it, the only time I am successful is when I set a goal, make a game plan, keep my head down each day and work toward those goals, and do What Ever It Takes to USE Adversity to Reach My Goals (wow, that just happens to be the title of my Motivational/Goal setting speech and Book Draft). I will fight, scratch and claw to get through this and get my life back on track, and God help those who stand in my way and impede me from taking care of my family. I am now using the Adversity of dealing with the Travelers again, and DO Gutierrez’s incompetent review of my records for the following items in order to take control of my life.
I am now not asking but DEMANDING a face to face with whom ever makes the decisions at the Travelers Walnut Creek office, I want DO Gutierrez in attendance, and I want ALL of my questions answered. I will make myself available any time I am not booked already (see attached speaking schedule)
1. Where did this information on my evaluation come from (some said it was from me, you depend on a brain damaged, short term memory deficient, seizure prone individual to supply accurate medical records to evaluate? This must be a joke)
2. How can DO Gutierrez who can’t even spell, or use proper English be able to correctly convey his evaluation of me (whom he has never met) to the powers to be. I think I should be doing my own evaluation; I have all my medical records which DO Gutierrez seems to be lacking.
3. He states I am on permanent disability. If so, why haven’t I ever received a check???????
4. Why such a short window on my attending the Amen Clinic. Dr Amen originally was going to condense my 3 day into a 2 (14 hr day study) and do my individual evaluations himself. I now have him for one hour on 9/22. I was hoping there would be a lot to be learned from my 28 year journey with hydrocephalus, which might prevent some one else from following my steps (Just think of all the money Travelers could save, or wait a minute, how much they would lose by not charging companies such as the 49ers for all the professional help they give. NOW it’s making sense).
I am already in contact with legal representatives, the NFLPA, and others, as I have no more time to waste dealing with you people. I will call your office in a moment to discuss when we can meet, and expect an appointment scheduled at the Travelers Walnut Creek office with yourself, DO Gutierrez, and the CEO of the office, as I would think it would be in the Travelers best interest to not continue to further cause physical and emotional damage to myself and my family.
I have attached my upcoming speaking schedule, and would appreciate you scheduling our meeting at the Travelers office to fit my schedule. I will make it ANY time I am not already booked. And you can tell your powers to be when I address the CA Brain Injury Institute in Bakersfield on 9/28 & 9/29 the Senate for the CA Brain Injury Association in Jan, CH 12 news Chico on 10/6, Chico Hydrocephalus Awareness Walk on 10/11, San Francisco’s Hydrocephalus Awareness Walk on 10/25, the National Hydrocephalus Association’s (HA) global meeting in Cincinnati in 2010, and WA DC for HA everyone will get an earful. I have nothing to loose, as I have already lost my memory, my wife and my kids, am rapidly losing my mind.
BREAK DOWN OF DO GUITEREZ’S EVALUATION OF MY CLAIM TO BE SEEN BY DR AMEN
(I was referred by Dr.Claydon)
I will number the sentences from the evaluation so as to be able to get a flavor for the extensive fumbling and bumbling Dr DO does while EVALUATING me and my head injury. There were only a total of 30 sentences in the entire evaluation.
Sentence # 2. The patient was frontally a defensive lineman on the SF 49ers football team. (He at least got the sport correct. Frontally??? Maybe formally???)
Sentence # 3. The patient is noted to have ventricle a peritoneal shunt because of hydrocephalus. (It’s a peritoneal shunt placed in the ventricle, but of course everyone knew that!)
Sentence # 4. The patient also indicates there is scoliosis about the central aqueduct (I did?) and indicates he has had no fewer than 8 shunt procedures in total ( I guess 9 is not less than 8 so he’s correct there.)
Sentence # 5 - 7. The patient subsequently has (I think he meant had, but my English isn’t all that great either) a generalized tonic clonic seizure in 1986 and 1998. The patient was placed on Dilantin while he was in the hospital (in 1986 or 1998?) but due to adverse effects was placed on Phenobarbital (I was on Dilantin for years) and remains on this drug ( it has taken them so long to review this to try to get me to see Dr Amens clinic, that I went from Phenobarb, to Kepra months ago which caused anger management probs, and now have been taking Zonegran and Kepra while I wean off Kepra, and Oh yeah, I also am taking 1-2 Xanax 3x/day and at bed to try to help me sleep since I quit taking the Lexapro and went 4 nights with no sleep).
Sentence # 11. Diagnostics were done and were normal. (What diagnostics, blood work?, and normal for what? Certainly not Homo sapiens I’m sure.) The patient has been weaning off Phenobarbital (WRONG) due to short term memory problems .
Sentence # 12 Dr DO Does not recommend I have a SPECT SCAN
Sentence # 20 = CONCLUSION (I know you must be holding your breath). The patient’s initial injury was over 28 years ago. (He has his math down, that’s comforting).
Sentence # 21. Since that time the patient has had a total of 8 brain surgeries (Shoot, there goes his math, my records say 9 but heck 8, 9 what’s the diff)
Sentence # 22. The patient now suffers from seizure disorder and is on permanent disability (I wish someone had told me I was on permanent disability, maybe I wouldn’t have had to depend on my Buff brothers to make 3 house payments for me this spring till I got 4 different businesses going, started conducting motivational speeches, Coaches Concussion Clinics and started writing a book to make ends meet.)
Sentence # 22 & 23. Progress notes indicate the diagnostics were done and were normal (What diagnostics and when? I am normal, OK ) However, there are no reports of any diagnostic testing included in this review. (Did I just miss something here?? I thought they were normal.)
Sentence # 23. The patient’s main complaint is difficult with short term memory. The patient’s physician believes that this could possibly be from the Phenobarbital and had switched him over to Lexapro (OK, I know I am brain damaged but this guy is evaluating ME??? The stupid shit doesn’t even know what drugs I am taking and what they are for; Lexapro has nothing to do with seizures, it’s for short term memory, thus you would not switch it for Phenobarb). I wonder why I have anger management issues. All I ever asked of the 49ers and The Travelers after I had to battle the shits for nearly 5 years to get my brain surgeries paid for, was let me finish my biology degree and I will take care of myself. I will challenge anyone in The Travelers or ANY Work Comp Insurance Company to find ANYONE who has worked harder and over came more than I have to not only take care of myself and family, but open new businesses, hire employees pay payroll taxes, and this is what I get, an evaluation from some stupid idiot who doesn’t have a clue about; 1.) Me and my case
2.) My type of injuries
3.) The necessary treatments required for my injuries
I would seriously like to see Dr DO on the bench answering some of my questions, and we may just go there. I am at a point in my life where I have had enough and heads are going to start rolling if people don’t do their jobs.

The patient was placed on Dilantin while he was in the hospital (in 1986 or 1998?) but due to adverse effects was placed on Phenobarbital (I was on Dilantin for years) and remains on this drug ( it has taken them so long to review this to try to get me to see Dr Amens clinic, that I went from Phenobarb, to Kepra months ago which caused anger management probs, and now have been taking Zonegran and Kepra while I wean off Kepra, and Oh yeah, I also am taking 1-2 Xanax 3x/day and at bed to try to help me sleep since I quit taking the Lexapro and went 4 nights with no sleep).
Sentence # 11. Diagnostics were done and were normal. (What diagnostics, blood work?, and normal for what? Certainly not Homo sapiens I’m sure.) The patient has been weaning off Phenobarbital (WRONG) due to short term memory problems .
Sentence # 12 Dr DO Does not recommend I have a SPECT SCAN
Sentence # 20 = CONCLUSION (I know you must be holding your breath). The patient’s initial injury was over 28 years ago. (He has his math down, that’s comforting).
Sentence # 21. Since that time the patient has had a total of 8 brain surgeries (Shoot, there goes his math, my records say 9 but heck 8, 9 what’s the diff)
Sentence # 22. The patient now suffers from seizure disorder and is on permanent disability (I wish someone had told me I was on permanent disability, maybe I wouldn’t have had to depend on my Buff brothers to make 3 house payments for me this spring till I got 4 different businesses going, started conducting motivational speeches, Coaches Concussion Clinics and started writing a book to make ends meet.)
Sentence # 22 & 23. Progress notes indicate the diagnostics were done and were normal (What diagnostics and when? I am normal, OK ) However, there are no reports of any diagnostic testing included in this review. (Did I just miss something here?? I thought they were normal.)
Sentence # 23. The patient’s main complaint is difficult with short term memory. The patient’s physician believes that this could possibly be from the Phenobarbital and had switched him over to Lexapro (OK, I know I am brain damaged but this guy is evaluating ME??? The stupid shit doesn’t even know what drugs I am taking and what they are for; Lexapro has nothing to do with seizures, it’s for short term memory, thus you would not switch it for Phenobarb). I wonder why I have anger management issues. All I ever asked of the 49ers and The Travelers after I had to battle the shits for nearly 5 years to get my brain surgeries paid for, was let me finish my biology degree and I will take care of myself. I will challenge anyone in The Travelers or ANY Work Comp Insurance Company to find ANYONE who has worked harder and over came more than I have to not only take care of myself and family, but open new businesses, hire employees pay payroll taxes, and this is what I get, an evaluation from some stupid idiot who doesn’t have a clue about; 1.) Me and my case
2.) My type of injuries
3.) The necessary treatments required for my injuries
I would seriously like to see Dr DO on the bench answering some of my questions, and we may just go there. I am at a point in my life where I have had enough and heads are going to start rolling if people don’t do their jobs.

2 seasons with the 49ers in 80 & 81 (Super Bowl), 8 emergency VP Shunt brain surgeries (the first during the 81 season which they successfully kept out of the papers), multiple grand mal seizures and 3 knee operations, including an experimental GoreTex ACL transplant (which they don't do anymore as they wear holes in the bone) and I qualify for exactly ZERO in pension or benefits from an 8 BILLION dollar industry, the NFL.
