Roger Clemens: Did Brian McNamee Submit False Evidence To 'DOJ'?

Brian McNamee handed the above “evidence” into the Department of Justice, just before his being heard by the Oversight Committee where he made allegations about Roger Clemens use of Winstrol (shown above), and HGH (also above). 

McNamee stated that "Winstrol is white" both in his deposition to investigators and in statements made to Hardin’s PIs, “not clear” like the Bonds “clear.”

  • Real Winstrol, as clearly shown above (just under McNamee’s evidence photo), is white and not see through. 

The other vial McNamee supplied was said to be HGH, which is a light-amber color and not found in brown containment-bottles at all. 

  • What is found in a brown containment-bottle though, as clearly shown above, is Vitamin B12.  B12 is a darker red too, just like what's in McNamee's "brown bottles" and that is why he was asked about the drug's color at the Hearing.
  • Of course the photo of B12 (above-right) is taken from China’s Black-Market (online-pharmacy), so one would have to be a criminal to obtain B12 from there, or a doctor – or one working for a “vitamin company,” like McNamee did for InVite Health in 2001.

What else is “clear-colored” and also mentioned in conjunction with Roger Clemens?  Shown above is McNamee’s “evidence” and all can see that it is clear. 

  • Lidocaine is also clear, per the above photo.
  • Roger testified to have taken Lidocaine for relief of his chronic "lower-back" problem.

Of course it is the Department of Justice’s (DOJ) job to prove or disprove Brian McNamee’s “evidence,” but McNamee testified under sworn-oath to Congress that "(he) never got any deals from the DOJ." 

  • His attorney, Richard Emery, later filed to have the defamation suit dismissed and founded his motion based on "McNamee operating under absolute immunity, a deal offered him by the DOJ.”

If McNamee’s evidence was sound, then there would have been charges filed already.  Instead, a wild goose chase has ensued brought to us by sadistic NY writers mostly from the Daily News – who was wrong about Shaun Kelley, Mindy McCready, Kelly Blair, Andy Pettitte and Jeff Bagwell relative Clemens. 

Needless to say, the fans know one thing they don’t believe when it comes to Clemens – and that's the Daily News.

Having called Rusty Hardin’s office recently and asking if his Private Investigators had found any evidence to refute McNamee’s accusations – he replied, “No comment.” 

When asked if it was a little strange that Clemens had been under investigation since 2005, when the Grimsley Affidavit was obtained by FEDS, and there is still no definitive proof –this time the reply was given with a smirk, “No comment.” 

  • Of course Rusty had recently said that he was not aware that the DOJ was handed certain receipts and he wouldn't had if we all didn't read it in the NY Daily News aka sounding board for Brian McNamee.  
  • Richard Emery has now given everyone more insight about the DOJ's investigation than its worth; and we wouldn't have known anything about the DOJ's investigation without PR Specialist, Richard Emery.
  • Nor would Hardin.

Hardin also said that McNamee had been planning this set-up since 2001, out of spite because Clemens wouldn't promote his on-line vitamin company, InVite Health, without proper compensation.

  • McNamee threatened Clemens with a suit in 2001. 
  • Andy Pettitte gave testimony proving that a rift between McNamee and Roger was prevalent within the allotted time, since 2001.

Assuming that Hardin isn’t "tipping his hand" while preparing for the defamation suit and while the former Federal Prosecutor, Hardin, is also navigating a federal investigation, then offering "no comment" is smart enough. 

Phoning the Hendricks Sports Agency and sending them a follow-up email with only two simple questions, 1.) If there is such a rift between Roger and Andy (like reported by the Daily News), then why do they still have the same agent together; and 2.) why didn’t Andy file a brief against Hardin?  You guessed the reply, “no comment.” 

Pettitte is under contract in NY and Clemens is a listed Free Agent who would like to play – otherwise he would have filed for retirement

Is there a spot for 22 on a injured rotation, somewhere?

With something more definitive needed, then just “no-comment,” one is forced to turn to research.

Some More Prying Research.

Steroids are a controlled substance, but are legal when prescribed.  What’s illegal is obtaining them on the street and without a prescription.  Greg Andersen, who did jail time for distributing “the clear” to Bonds (via Balco), certainly must be taking note of how both McNamee and Radomski were shown favor by the same office that prosecuted him to the furthest extent of the law.

Victor Conte (ex-Balco Owner, current convict - turned cooperator), called out McNamee’s testimony saying that what McNamee said was incorrect.  McNamee said that he “hurried and botched the injection of Winstrol in Tampa, which caused an abscess.”

Of course that information wasn't made available until McNamee was actually deposed by Congress - after having been told by George Mitchell to "be forthcoming, not to exagerate, nor to minimize anything" and after having given his statements to the "Mitchell Investigators" (or DOJ?) which were confirmed and then re-confirmed up to 5 times before the Mitchell Report was released- yet somehow he forgot about Tampa? 

  • See Tommy Craig (Blue Jays Lead Trainer) and Dr. Taylor’s testimony (Blue Jays Team Doctor) – pg. 14- about injection-injuries and B12. 
  • There wasn’t an injury in June that the trainers knew about, nor in September, which are the only months that the Toronto Blue Jays played Tampa Bay- in Tampa.
  • Dr. Alan Gross is the Toronto Blue Jay's Orthopedic Surgeon and he examined Clemens injection-injury caused by Dr. Taylor and testified to it not being an abscess, "it was only a contusion or bruise."
    • Somehow Dr. McNamee disagrees with the expert and the MRI - which is mechanical and not able to lie about results.
  • Scott Shanahan, Toronto Blue Jays trainer (under Craig) testified to not believing any of what McNamee stated.  He said that McNamee was "too shady" and he stayed away from Brian altogether.  He also testified to having "no reason to suspect Clemens of using PEDs."  He said "everyone knew about Canseco though" -  further giving him more credibility.  

McNamee said he took Clemens into a private room at Tampa and “pushed the Winstrol too hard and too quickly" he said, "it pooled and then abscessed.”  He qualified this by saying that they "were in a hurry and didn't want the Blue Jays to find out about it."

Conte stated thatWinstrol doesn’t need to ever be pushed hard at all, because it has a thin consistency," and followed up saying "that you just push it and bam, - its in - it wouldn't have pooled,” Conte added that, “the only thing that needs to be pushed hard at all is testosterone,” not Winstrol.      

The fact that Clemens had been using B12 and Lidocaine has been made clear too, which supports Clemens testimony as being “truthful.”

Starting in Boston, where Clemens pitched from 1984 to 1996 and had his best career numbers, Dr. Pappas(BOS) testified that Clemens could have been using B12 without team knowledge, because the team does not prescribe it - but they also allow athletes to get prescriptions from their private Doctors, especially when concerning vitamins. 

  • He said that he had no reason to suspect Clemens of PED use.

Dr. Fran Pirozzolo attested (Houston Chronicle) that he had “actually used both B-12 and Lidocaine with Clemens when working out with him.” 

He is an accredited sports psychologist who had worked with Roger starting in NY through his years with Houston – which oddly enough are the same years covering McNamee’s allegations. He also stated that he would have picked up on the many signs that steroid user’s exhibit and didn’t see any signs of steroid use by Roger. 

Blue Jay's Team Physician, Dr. Taylor, testified this past-off season that he injected Clemens with B12 in July 1998 and then  recorded it in the injury reports.  Clemens did not have any injection-injury sites, like McNamee stated he did.  IN other words, the records refute McNamee. 

Dr. LaBossiere, from the Astros, stated that Clemens could have been using B-12, but the team didn’t prescribe them nor test for them.  Dr. Littner made clear that Lidocaine is a numbing agent (like Novocain) and could provide up to 4 hours of relief for pain

  • Clemens had chronic lower back issues and his Toronto Blue Jay's Chiropractor, Dr. Patrick Graham, stated that he never once saw signs that Clemens was using steroids too. He never saw any abscesses, nor pimples nor any other signs of steroid use on the body that he worked on so many times-He stated that "Roger was clean.”
  • Yankee’s Head Trainer, Gene Monahan, also stated that Clemens could have been using B12 while in NY, like Roger testified to having done – Monahan stated that the Yankees, like the Red Sox, do not even keep records for vitamin use.  He also testified that Clemens did receive pain injections while a NY Yankee too

Coupled together Monahan’s and Pirozollo’s statements and it is clear that Clemens was using B12 and Lidocaine when in NY, just like Taylor and Craig testified to him doing in Toronto.  

Jose Canseco played for the Red Sox, Yankees and the Toronto Blue Jays along with Roger Clemens.  Everyone states was the most honest of all in the whole steroid controversy, stated that he believes Roger Clemens and called McNamee a dirty liar

  • Canseco testified to have never been contacted by the Red Sox Legal Consultant, George Mitchell, regarding his knowledge of steroid use in baseball relative the Mitchell Report – despite Mitchell having attesting that he and investigators had talked to Jose prior the report. 

McNamee’s statements were confirmed several times by both investigating authorities and by George Mitchell.  Yet somehow McNamee changed the Report while giving his deposition and it was overlooked

  • He stated in the “Report” that he had injected Clemens 4 or 5 times total and that "each use was in Toronto," while their ace, and once in NY. 
  • But in his deposition he stated that the “real” total amount of injections was from 8 to 15 times – and not only in Toronto at the Jay's Skydome (which he was so clear about to Mitchell) but also in Tampa. This information must have slipped Brian's "foggy memory." 

McNamee said in his depo' that the injection in Tampa (after Canseco’s party- in June) "caused an abscess" and that "The Toronto Blue Jay’s trainers knew about it."  The only injection-injury Clemens had was in July (not June) and the trainers knew that it was caused by Dr. Taylor’s B12 injection

  • When confronted with the discrepancy by investigators deposing McNamee, he threw a wild pitch and said it might have been in September – but he clearly stated that Clemens quit after the injury and threw his paraphernalia into McNamee’s locker – now shown above.  
  • He qualified this by stating that he gave the pills to Canseco – who "popped a couple" according to Brian.  Canseco said that "no professional ball player used pills. They’re way too dangerous," and said McNamee is lying about Clemens.

When asked to confirm McNamee, Andy gave the real account on page 34 of his deposition.  McNamee and Pettitte were at Andy’s gym, between 2002 and 2004.  Andy said (page 33 of his deposition) that he was going to promote McNamee’s vita-care company, InVite Health, in return for a supply of vitamins. 

When asked if he believed McNamee (about he giving Clemens "steroids"), Andy said “no.”

He went on to say how McNamee always blew off steam to him and he just used to listen in order to placate him.  He said McNamee always had stories of grandeur and Andy didn’t believe a lot of them – just like Presidential Adviser, Karl Rove

Bush oversees the Federal Prosecutor’s office by the way – but maybe they don’t have any real insight to this story.

HGH wasn’t even brought up for Andy's use until in 2003 when McNamee (according to AP’s depo’) stated, “HGH does help the tissue repair itself.”  Afterwards Pettitte took McNamee down to Tampa in order to "help him" recover from injury; which isn’t exactly Roger pushing drugs on anyone.    

Finally, Andy said that he "was speculating (page 21) about a conversation that happened 10 years ago...and hated to do that..." in reference to Clemens telling him about HGH or using it.  McNamee was not there. 

  • Andy was then paid a “visit” two days prior the hearing by Jeff Novitzky about submitting an Affidavit instead of testifying.
  • After wards Andy motioned to withdraw "becuase of the nature of his fatherr's involvement" and not as to whether or not he would "danage Clemens."
  • It also seems relevant that if Roger and Andy were best friends, travel mates, team mates, and both Aces then the two would have had more than one conversation over 10 years about PED use.  

Research on the 'legal' drugs in the Mitchell Report, that were obtained 'illegally.'

HGH is legal for US citizens to use and can be purchased online, without a prescription

Some online sites suggest using their products “under the supervision of a Doctor” and offer “free Doctor Consultations” at the same time.  It seems like some Doctors are the real drug dealers and as long as they have the title “doctor” they go un-checked, which may be the reason that McNamee faked being one.   

Pharmacies are forced to cooperate with those who control the black market on steroids, and some pharmacist end up dead.   The NYPD was busted in a steroid ring where the Gambino crime family apparently involved, but what would McNamee have to do with this fact?  His name appears in the articles linked and his involvement is yet to be known with the NYPD steroid ring.

McNamee was a under-cover super cop who worked for the NYPD for 3 years before entering baseball where he went on to be commonly known as a drug dealer – along with his good friend Kirk Radomski, who Is now a convicted distributor of steroids and GHB (date rape drug).

When it comes to this scandal being too much a distraction for baseball or the investigation taking too much a toll - how's Miguel Tejada doing this year?  Were you shocked that he played in the All-Star game while facing such a controversial investigation?  He wasn't banned?

This investigation goes to the core of the MLB - as an oragnization operating under an "anti-monopoly clause," which is an attempt by our government to curtail any abuses formed result of that "monopoly."

The term is "anti-trust exemption," which basically allows for a monopolized market, but with exceptions - one being a "mandatory level-market playing field," making it fair for all.  How would the league's (owner's) knowledge of steroids affect certain markets?

If the league allows for the use or simply ignored it (which they did until 2003) knowing that those players charge more than the average, are they allowing for the bigger markets to sign the better players based on steroid use, a team's "money," and free agency? It would not be a level playing field between markets at all, in that case.

As for pardons regarding “liars” and “cheaters”Clinton was pardoned for lying, even after being impeached for both Perjury and Obstruction.  Both John Edwards and Elliot Spitzer recently confessed to “cheating” too, after both had lied to the American Public– but then again, why would a sports writer talk about politics anyway?  

It certainly does the reader no good, when he looks for the sports page to read about his team – and ends up soaked in one’s political “soppage.”

      I have 2 more articles regarding evidences (and hopefully some comments this time) and then one about a certain starting rotation that needs help - and then I am done with this one - finally.

      Thanks for the comments - this seems a little fishy to me too, then again "it" is McNamee we are talking about so we shouldn't be surpirsed - - -

      They have 5 pitchers injured - I think they should reconsider not wanting Clemens, "because he is 45..." - thats what Hank said after supporting RC in the off-season.

      The whole team supported RC in the off season too. I am sure that when Hank said that, he didn't know that 5 starters would be injured though.

      It is pretty tough to watch teams like the O's, TX and Tor beat them Yanks senseless though- agreed.

    But wasn't McNamee a cop before meeting Clemens? From what I have read in this article there is only one clear liar, which is McNamee; and especially to the Tampa Police Department regarding rape.

    That "is" what it says, and it is what it is.

      I watched on as McNamee said he was telling the truth in the Mitchell Report and then I laughed about that when I read his deposition.

      No, "the earth is not flat," which is the exact reason that you should not believe everything that others tell you is so true. How 'bout them Jets?
      You prove your own point by not thinking out of the box.

      Readers, especially on-line readers, have learned to question everything and especially about scandalous events, which this article does.

      I say good for Pat. It is a rare quality that a writer takes an opposiing view, especially considering some of his colleague's "work."

      Didn't Clemens beat you Mets in the 2000 World Series, so is that what your real problem is?

      And why wouldnt Clemens trust a cop to follow the law, and not to breake it?

      Donna Summers? Interesting, though I always looked at her as Mo Town's answer for Disco.

      No, I was referring to David Boey. He was the disco guy in the 1970s that led to Duran-Duran and then some Flock Of Seagulls or Eagles or Pigeons.

      All the sudden society was flooded with some real alien looking people. The end all was Boy George, after that everyone stopped and looked at each other and said, "wow, that's just taking all this too far."

      And then grunge rock was born!

    I get it now, the Toronto Blue Jay fan is only 16 yrs old and has no idea what happened in 1997 and 98, because he was busy at work with the new match box toy car.

      Maybe he could start a brand new site - all centered around himself and toy cars. whaddya think? He could pontificate on how "those toy cars dont matter becuase they are not new toy cars" - and then censor all editorials about certain "toy cars" who make him frown. but if you write a piece on his favorite toy car of all, and when it was a champion - oh boy, wally - hot dam. the article would sit tall and proud right on the front page in grand ole lights...

      Clemens doesnt have a PR team - that would be McNamee and his mouth-piece (Daily News) that is offering you all the anti-Clemens propaganda...are you judging one side of the story "with an open mind" - that is an oxymoron - and open mind requires you take in all the information - not one side that is mass-produced by the mass-media -

      Tyson's chicken sucks for good reason! So what open mind are you thinking with that takes one side of the story and not the other? In other words my friend...you're full of it, for now -

      Suffice it to say, Hardin does not share case sensitive info with the press or the public -

      This article would demand you really have an open mind - but of course you wont read it in the Daily News - because it is more profitable to report the negative on Clemens than McNamee (we already know he is a scum bag) and it actually requires the reader to analyze and use their critical thought process- which the daily news wants to do for them...they want to feel needed and important - they need to in order to make $$$ coin!

      here's the next article - if you had an open mind at all - then these two would be sure to get your attention - if you buy that which is sold you by the mass production-style media, then youre not open minded at all -

      in which case, youre a front runner who is too afraid of being picked on - the mass produced media makes it simple and does the thinking for you - sometimes those that claim they have an open mind really mean....the have no mind at all

      I think you'll find that Hardin was right all along - Clemens was set up by a guy who has carried a mean grudge against him since 2001 - don't forget, McNamee is used to the set-up game thanks to his job experiences -

      unfortunately for him, he told congress that his "grudge was a dead issue as of 2003" and then Pettitte came in and said "McNamee was still very upset at Roger about his not promoting InviteHealth" - date 2003, the same year that he and Kirk "shipped" drugs down to Texas - with McNamee's name on it - - - but it was sent while McNamee was still in NY with Radomski - for some reason they didnt mind a paper trail for that one....read about it in that link I supplied you - and enjoy!

      Lupica? No, he is too busy slandering others to make his wallet fatter than his head - :o) just my take though - I find that I don't usually agree with people who graduated from Boston College - like Lupica.

      Print journalist used to be held to a higher standard - and then the Daily News tabloid did the cost to benefit analysis about defamation and figured "the hell with it", they make a lot of money off of printing stories of grandeur that have no foundation at all - not my style.
